I think there are arguments why it might not be. Spelling apart, 'trial' is mostly used as a noun, rarely as a verb. And 'try' is probably more often used as a verb.

I saw 3 times today "would of been" instead of "would have been"

Well, maybe if you just smack them with a dictionary...
I hate that one.
And people who say "lay" when they mean "lie".
And people who try to be extra-correct and get it wrong, like saying "My brother invited my sister and I to dinner." It's "My brother invited my sister and me to dinner", or "My sister and I were invited to dinner by my brother."
Obviously, "My sister and me were invited to dinner by my brother" is wrong, but the other way round is even worse, because people are so obnoxious about thinking they're using good grammar when they do it...

But you wouldn't say "My brother invited I to dinner", would you?
Or, if you're talking about your sister, "My brother invited she to dinner"?
