Not only is the Godfrey/Demon case of dubious applicability, but any precedent set by it has been superseded by EU Directive 2000/31/EC which clearly states in Article 15 [ahem]:
"Member States shall not impose a general obligation on providers, when providing [hosting] services, to monitor the information which they transmit or store, nor a general obligation actively to seek facts or circumstances indicating illegal activity"
Furthermore, Article 14 makes it clear exactly what the Beeb's legal responsibilities are [ahem]:
"Where [hosting] service is provided..., Member States shall ensure that the service provider is not liable for the information stored... on the condition that: (a) The provider does not have actual knowledge of illegal activity or information and ... is not aware of facts or circumstances from which the illegal activity or information is apparent; or (b) the provider, upon obtaining such knowledge or awareness, acts expeditiously to remove or to disable access to the information."
To summarize, the BBC is NOT legally required to pro-actively moderate. If there is a Linda-button complaint, then they ARE required to investigate and act accordingly, but that's not what we're seeing now, is it?

Ok, outside link posted and tested - there it is at the very top of my own space. Now on with the rant...
So, it is established that the BBC has NO obligation to do what it's doing under relevant Internet law, but there is another thick legal document to consider: http://www.bbc.co.uk/info/BBCcharter/index_cf.htm
That's the BBC's charter, which ties it to the crown and makes it different from any ol' private ISP. I still need to pore over that one, and I'll do it soon, although it's written in thick British Legalese (and I thought languages like that were /verboten/! Bubblish is certainly easier to understand!)
I suspect that what's going on is not a legal issue at all. The BBC is a BROADCASTING company, and always has been. They imagine that H2G2 is another BBC PRODUCTION, and they are accustomed to having censorial control over their own productions. It must drive them crazy to think that any anonymous freak could post anything they want on a page which clearly bears the name 'BBC ONLINE'. Well, it IS the twenty-first century, and such is the Internet. H2G2 is NOT a BBC PRODUCTION, and it will NOT be one. If they want to HOST us (which is fine! I like being hosted), then they have to learn what it means to be a HOST on the Internet. A new business paradigm is required for dealing with the Internet! (DNA regularly makes this point more eloquently than I can.)
So, anyway, I guess I've shouted enough for now. I'd really like to go work on a non-Zaphodista-related entry, I think.
