no no
Constructive Dismissal is something different. It is when your employer makes your workplace somewhere where you can't work for reasons like: bullying, discrimination etc. It's not like a normal resignation / firing scenario.
Which is why I have to check exactly first.

I know what you mean. That's also how I understood it. Problem is, I have never heard of a special expression for that. It would be quitting for severe reasons *außerordentliche Kündigung aus Gründen der Unzumutbarkeit der Zusammenarbeit* (that is how I would put it in official words).
But that is very difficult to proove - and therefore it might be rejected.
There is also (usually) the problem, that this special form of notice has to be given within two weeks after the reason for it is known. Though this might not be so in this case, since the misbehaviour is a continuous one and begins to be unbearable (that's how I would argue)
I hope though you can get through with it.

well, I'm only checking it out for now
I can't imagine that I'll quit - since you know how difficult I'm finding it to find a new job. But it's nice to be informed!

yes, you should only quit when having a new job. Though I would understand if you did without that security, but we both know the job situation here in Germany

I came upon this thread quite late, so I hope the situation has improved, or otherwise been resolved.
I left my last employer (once I had located a better position) due to (apparently) a similar working environment (a very difficult working relationship [unbefriedigende Arbeitsbedingungen?] with a supervisor). Although the laws are different in the US, I also had no possibility of a legal basis for claiming discrimination or harassment. My supervisor's dissatisfaction with the quality of my work had an ever-shifting basis, and it became too stressful to adjust to the guessing game regarding what precisely was being requested.
As mentioned earlier, the best bet is to explain to union representatives what the issue is (I was not protected by a union). They should have a term that is most appropriate to the goal (achieving maximum unemployment benefits if one is unable to remedy the situation with the employer and unable to find another position.

blimey, I'd forgotten about this thread!
As it happens - the boss that was bullying me has gone. He did bully someone else into quitting before he went though, and we all had to stand by and watch since she was in her probationary period (and, arguably, knew far far more than I did what she was getting into)
In the meantime I've just passed my 10 year anniversary - anyone who wants to fire me would have to have seriously good grounds.

Oh thanks, Thomas.
The situation managed to resolve itself with a bit of a gentle push.
and now I'm over to your space to introduce myself properly.
