First can I apologise for only appearing on here when I need help. That is in a way a compliment to all of you because I can usualy get an answer to my prob as there is such a wide audience out there and you are all fonts of knowledge on different subjects ( some subjects are I have to say a bit iffy but Im sure you are mostly harmles...)
Im hoping there is a bod out there in the ether who knows about sick pay and how it is worked out.
This is the first time I have had to claim and my boss is an absolute chocolate tea pot and relies totaly on his accountant, who Im sure is telling him wrong.
Despite what Mr. accountant says Im sure Im elegible. Ive studied the goverment web sites, Ive phoned the HMRC 3 times and they say yes...the problem is they come up with different ways of working it out...which in itself is quite worrying.
I also phoned ACAS and they said I couldnt claim because I am under the national insurance contribution level...tho the NIC dept who I spoke to said NI contributions have nothing at all to do with sick pay..
I earn over £90 a week.
The weekly sick pay allowance is £75.40
I work 3 days a week, thurs, fri, and sat.
I was sick fri, sat, thurs, fri, sat.
One HMRC person said I divide the 75.40 by the number of days I work a week (3) then multiply it by days I can claim (day 4 onwards) thus I can claim for 2 days - £50.26
Another person at HMRC said all 7 days count in a week even if you dont work on them usualy so I can claim for a whole week as my first 3 unclaimable days were fri, sat, sun then I had a whole working week off so Ill get £75.40.
Im sure this is supposed to be easy but Im stumped now.
My boss is still sticking to his accountants advice and wont pay so I have given him a SSP1 form which he has had for 4 weeks and only now has decided to get his accountant to fill it out so I wont see that again in a while.
Im just glad it was only 1 1/2 weeks, had I broke my leg I would be out of plaster and training for the London marathon before I see any money!!

First off, statutory sick pay is a daily rate not a weekly one. It's about £13 a day, up to a maximum of £73-odd in a week. If you were off ill for three days, you're entitled to three days SSP.
If you are employed, you are entitled to SSP regardless of the amount of contributions you have made. Only the self-employed who have not paid NI cannot claim SSP.
Speak to Citizen's Advice who will act on your behalf if you want them to.
