PCN: To Challenge or Not To Challenge?

Post 21

YalsonKSA - "I'm glad birthdays don't come round regularly, as I'm not sure I could do that too often."

They had gone round to all the signs showing the parking restrictions and stuck 'Sun' over 'Fri' with little labels. It was the weekend of the Tour De France visiting London, which as far as I'm aware didn't come anywhere near Pimlico.

I wouldn't have paid the fines my girlfriend got. If you object to a PCN, your first recourse is to appeal through the council's own complaints procedure. All councils have to have one, so yours will, too. These merely check whether the proper procedues have been followed, though, and won't revoke penalties that are simply unfair or even illegal if they have been issued according to the council's own self-written guidelines. This is another bully tactic, as they will try and make you think that this is an independent and legally binding review. It isn't. If you are still unhappy then you can take your protest further to the parking ombudsman, and finally the court if you are still unhappy.

As I said, challenge your tickets on whatever grounds you have. Keep all correspondence and documentation and take pictures of any alleged infringements. If you have any sort of case it is likely that the council will have been sloppy enough to hand it to you on a plate long before you ever get to court.
