This is not explained correctly in the article.
You may use the middle lane if there are cars on the right lane at least from time to time. Only the left lane is reserved for overtaking.

Sorry for being a little late...
Ok, maybe.. but what is 'from time to time'? If you ask the kind of people who justify their behaviour by citing this paragraph, then 'from time to time' always means: from Easter to Easter, and these guys switch to the middle lane as soon as there is one - no matter whether there's any car up front. They tend to neglect the basic rule which is still there: Keep to the right.
