In order enter the US under the visa waiver program you can't even have been arrested once the London Embassy. When I checked the State Department website it made mention of convictions, but the form you have to sign to be let into the US from the airport asks if you have ever been arrested if I answer "yes", I'll be deported at my own expense. So, I have to apply for a visa and apply to local police for kinda disclosure thing to provide at an interview I have to make an appointment for at the London Embassy and there is no guarantee that after going through this process and paying my fees that I get a visa.
When I was seventeen I was arrested on suspicion of what they call "Moral Turpitude" and given a police reprimand and a few years ago I was arrested on suspicion of assault and given a police caution for Actual Bodily Harm.
Under UK law I don't have criminal record, my supposed crimes are "spent". Under US immigration law I'm a potential undesirable and if they decide I am and turn me down for a visa I will be forbidden from entering the US in perpetuity.
Getting this process sorted by October is gonna be a challenge visa or no visa.

Best stay where you are then. I've only recently seen a report about a mna having been arrested the very moment he exited his plane in the USA. They had some false reports there, he hadn't commited any crime or anything, yezt he wasn't even allowed to make a phone call or anything. What with them abusing the data of tourists, it's just a no no country to go. Shame, that.

Pah. An ex of mine had just spent a month in jail for drunk driving, but happily checked the "I yam a good bloke, me" box and entered without probs. It's 20 years ago though, and they've gotten a bit more paranoid since, admittedly. I wouldn't check the "bad boy box" for your little episode.

I really want to get there and take Stephanie in my arms so, it's tempting to say 'soddem' but... it doesn't feel like a good move and the consequences mightn't be so good.

Subject Access form could take 40 days to process.

Still don't think it would be wise to try and go Visa Waiver and lie on declaration at the airport, not like I could plead ignorance and I doubt ignorance would soften the consequences.

if you believe you qualify for the US definition of non-moral-turpitude, then you can 'not check' the box and pass customs with a clear conscience and with its resulting body and face english (hehe forgive the pun there) of innocence. You have to believe or they will suss you out.

granted... the table is headed by something to the effect that the moral-turpitude must adhere to the country from whence the applicant comes from.... but but BUT...

if you meditate upon the SPIRIT OF THE LAW it is possible that you can pull off a belief in, and demeanor of, your own personal innocence!
