There is an interesting essay by W H Auden on this point. Apparently usury was only legalised in England in the 1560s, and even then there was the question of Deuteronomy Chapter 23 Verse something which explains that you are not allowed to loan money at a rate of interest to your kindred, only to aliens. Therefore Shylock would be by definition an outsider.
