I fully expect that my taxes will be audited this year.
My ex wants to claim one of the kids on her taxes this year/ Here's the problem, she is so far behind in her child support that any refund she gets is coming to me anyway.
I'm going to call her and advise her that I am claiming both kids and that if she feels she needs to, she can claim one and get us both audited.

They live with you, so you are the logical one to claim them as dependents.
Being audited isn't the end of the world. F and I were auded several times because we claimed an office in the home. that is one of the things that flags audits. But we always kept good records and never had to pay any extra. Of course it took time we would have rather been doing something else.

My lawyer has advised me that the deduction usually goes to whomever provides the financial support for the kids, although that is not carved in stone. In my case, we will probably end up alternating each year.
Since your ex is behind on her support this should be a no brainer.
