I have a couple of questions:

He's described as "Marshall" at the beginning but later you say he's retired, so why does he consider it his duty to shoot Miller?
If Miller had been pardoned for his crime and set free, why would Kane need to raise a posse?

Kanes situation is complicated. Frank Miller swore bloody revenge on all those who tried to put him away, including Kane. Most of the people involved run, but Kane stays, believing its his duty to defend the town, and that if he starts running now he'll be running all his life.
The townspeople disagree, for a variety of reasons. Some of them feel the town was livelier when Miller and his gang still roamed. Others feel that so long as Will is gone, there won't be any trouble at all, and the new marshall will arrive in the morning and make sure law and order is kept.
