Hello Blues,

Would it be possible for me to ask a work related question of you relating to a legal matter?

I'm back now, so feel free to ask away. I can't say if I can answer the question until I've heard it.

Cheers Blues,

A pal of mine was recently ejected from a night club, during the incident he was basically savagly beaten. The bouncer dragged him to a CCTV blind spot and kneed him in the fac a couple of times.

The result was that he spent nearly a week in hospital, had a operation on his nose and missed three weeks of work. His girlfiend took lots of pictures of his injurys so there would be some evidence, and obviously he has all the hospital records.

The trouble is the police have "allegedly" looked into it and are terming it a "Lawful Ejection", consequently as it has not been recorded as an assault Chris cannot claim criminal compensation.

As far as I can see (I have looked at the Licencing Act and the Private Security Act) I cannot see where doormen are given this kind of power and I think Chris has been stiched up, and basically I am wondering if he should go to the police complaints people.

I reckoned gived your line of work you might know something about the topic.

I think I'd be very foolish to comment on this given my line of work.

Sorry.

That is understandable, I would not want to in any way compromise you proffesionally, I realised you might not be able to comment, but I had to ask all the same.

I'm being a bit unfair, forgive me.

I'm loathe to comment because in my experience the police loathe bouncers above all else, so i'm surprised that they were so quick to find what they did in the face of massive injuries. It's very puzzling.

If i were your friend, I'd want to know why the police view it the way they do in the face of his obvious injuries. Get something in writing from somebody senior and you may have a better idea as to what they really think.

Cool, thanks for the advice.

I think what has happened is that my pal has err... history. Does not mean he desrves to be beaten up.

I feel quite strongly becuase thew same bouncer punched me a few months ago, I was not even drinking but because it was not on CCTV they could not do anythng...

I really didnt mean to put you in a position bud and am very greatful for the advice.

You didn't. I was having an attack of post-holiday blues. I apologise.

I agree entirely. Just because you have history doesn't mean they have the right to give you a thumping. As a matter of interest where are in the country? Thats a strange attitude to cctv in my experience...

In Plymouth.

Basically I have decided against drinking in town at all now.

There are some real problems with the doormen down here according the the lady from the CAB I went to see about this. I have decided I much prefer to have a quiet at the Seymour (a1165510) my local than run the gauntlet, I suppose I am just getting to old for town now.

Ah. I hear that Plymouth is basically a great dump of concrete and unpleasantness...

Still, I can't believe that they've taken that attitude. Just seems...wrong to me. And thats on a personal level, not a professional one. Just because something isn't on cctv doesn't mean it didn't happen.

I know, that is why I really think my mate should take it further, he has clear evidence of something having happened to him...

On Plymouth it is a bit plain, but has some very nice bits, the Hoe (which is the sea front) is lovely as is the "Historic" barbican. That aside Plymouth is pretty plain and dull. Still it does mean we get to live near the sea and the moors which would be ok if I actually had a car and could get there smiley - winkeye...

Did you have a nice holiday?

I avoid any pub that needs bouncers on principle these days. In my experience they are the pub equivalent of a self-fulfilling prophecy.

It was a great holiday. Sun, cheap booze, cheap food, cheap booze, sun, did i mention the cheap booze and food? smiley - winkeye
