They can only attempt to prosecute for the animals who were actually harmed, they have removed the animals but I can assure you, every single animal that is not ill through neglect will have to be legally and volountarily signed over by the owner (up until they get legally banned from keeping animals) and cannot be rehomed properly until that happens.
Now, chances are the owner is infirm or something and was not able to cope but honestly, there's NO excuse for this getting so bad.
There's NO excuse for animal welfare officers not to have proper powers to deal with situations before ACTUAL harm is inflicted if enough evidence is put together to prove a poor quality of life is being inflicted on animals be it by accident or on purpose.
These cases make me so angry. I needed to rant.

I despise the RSPCA with a passion. They have far too many powers as it is. And they're quite willing to bullshit to get there way. And far too amny of their attempted prosecution are spurious or targeted at those who are clearly mentally unstable and need help to stop them from neglected themselves. And they far to prone to pursuing politics.
Yes this incident is horrible and I'm sorry that the IHPL didn't hear about it before things got so bad.
Yes the law needs to be changed. But so like in Scotland tour CPS stops the heartbreakingly agonising cases the RSPCA idiots clog up the courts with from wasting court time, ruining peoples lives and wasting money donated to them to hjelp animal welfare not hurt innocent people.

I was pretty specific I know the RSPCA have unfortunately lost their way...
Animal Welfare organisations need to be able to do things properly.
Mind you, we cant even protect children properly, so I dont know how we're supposed to deal with animals. While people think they have a right to torture other humans, animals wont get a look in.
Like Dangerous Dogs acts and so on, usually a law is necessary and powers should be given to people, but getting the laws, the people and the powers implemented in a helpful way rarely happens.
Doesnt mean that the essence isn't right though.. People should have animals removed if they cannot look after them properly, Animals should not be left in the hands of people who continually over/underfeed them to the point where they have low quality of life.A horse can be left for weeks tied short to a stable wall and barely watered let alone fed but until it is ACTUALLY harmed nothing can be done? What absolute RUBBISH. We're supposed to be a nation of animal lovers but we're not, we're a nation of animal OWNERS. and the difference is, well, here's a case in point.
I'm sorry, I know there's no easy solution, but I get so emotional with cases like this. If these horses were born and left running wild and taken down by bad weather, natural predators and natural illnes,, so be it, but if people are going to take responsibility for another animal's welfare, then I'm sorry, you have no right to let that animal suffer in any way.
