1. In America, unless you have a "Master Falconer" license you can only falcon with a Red Tail Hawk (also known as a Buzzard in some places) or an American Kestrel.
2. You usually have to get the bird out of a nest your self, just for your first one.
These are what I've read from multiple sites, on the subject. Each Country has different rules, the ones stated above are American, the second one might be true in the UK also.

Just to clarify - in the UK, taking raptors from the wild is absolutely forbidden. Birds must be captive bred.

I thimk it's also illegal in the US. Please correct me if I'm wrong.

It is legal in the US but controlled and only with in your own state.
