Every Man and their animal for them self…

The week beginning 1st of November 2004, a case was heard at Lewes Crown Court, wherein the accused, the defendant, was acquitted and the victim, on whose behalf the crown prosecution service (C.P.S.) put the case before the court, was severely slandered by the defendants counsel. The victim, a woman, known to be struggling through life with mental health problems, suffered two indignities; firstly the crime committed against her went unpunished and secondly herself, who had done nothing wrong, was, metaphorically speaking, broken apart. The same week my self attended at Hastings Magistrates Court, to be sentenced for a crime which I received a conviction, in my absence, a month or so earlier… I completely overlooked the day, being very much embroiled in other matters of importance, and besides had not been involved, so to speak, with said case for months; the legal aid solicitor I employed had not bothered to notify me just prior to the date of the hearing. The penalty imposed upon me was that of £150 costs, and 160 hrs community punishment, which taking the declared minimum wage as a mean, is the equivalent of several hundred pounds. This year I have received two convictions in Courts of Law, including this one as mentioned. Yet I have not spoken a word in the course of any trial concerning me. At the other trial I pleaded guilty, being advised by a barrister that I would be placed in prison if I did not plead guilty. The charge against me was that of racially threatening another person; which in fact I did not do. On the first mentioned occasion I was, as stated, found guilty in my absence of harassing another person; I did not commit the crime as charged, thus I duly launched an appeal. As well as these shenanigans I was also arrested during the summer months being this time accused of harassing my Albanian neighbours, who at that time hardly spoke a word of English. The policeman investigating this eventually capitulated, conceding that I never had harassed the group of Albanian men, whom coincidentally, are fairly brutish types.
Setting aside the first prosecution, that of racially threatening another, and concentrating on the second, the harassment charge, allow me to make these observations. The individual, a woman, on whose behalf the CPS brought the charge, made claim that I harassed her as she walked her dog on a Public Lawn, which is sited directly outside of my home and which constitutes a major feature of the local area. Over the years the problem of Dogs fouling this lawn has generated much by way of controversy. Indeed, prior to 1997 there were polite notices, strategically placed, requesting owners not to encourage their dogs to toilet upon its surface; which given the placement of the Lawn in relation to homes, and a hotel, overlooking it, and its general location, was deemed the most responsible course of action. As a consequence the Lawn remained pleasant to look at and walk upon (many mothers enjoyed setting their children down upon it) and those dwelling close by were not subjected to foul smells and a dirtied grass area, horrible, particularly during periods of hot or humid weather. I myself have written many times over the years, to various Council departments, with regard to one circumstance or another concerning the lawns well being; it is after all a living thing. In recent times such reports have been met with alarmingly patronizing response. I can affirm that in the course of the 15 years I’ve lived next to the Lawn, I (and other neighbours) have requested numerous dog owners to desist from letting their pets foul the Lawn. Most people take polite approaches with good faith ( I have become good friends with one or two of them) and do stop bringing there pets to the lawn, however there are other dog owners who take some kind of personal exception to what is being asked of them and of these several have become extreme in their response. The owner who had me dragged through the courts recently is one such example; so extreme was this individual that for almost two years they have stalked and on numerous occasions abused me.
Anyhow the point of this review is not to discuss [my] individual cases but rather to concentrate on the legal system as it is currently evolving; an evolution which comes to be as much if not more concerned with politically inspired correctness as it is with criminal correction. Indeed it would seem that the modern legal system is unable to keep pace with a media created society that owes its influences to all manner of perverse notions and violent ideologies; so that the law itself has become an item of fashionable concern, such involvement providing society with an ever more frivolous and unimportant judiciary, which preys upon the mentally ill, or else targets otherwise disadvantaged culprits of a convenient making. The truth of this is born out by how modern police forces react to crimes as they happen. Often, when people are in serious trouble, the police turn up long after the event is over; more and more this occurs. Other times, as if acting out of boredom, policemen call upon and press spurious charges against individuals, sometimes months after alleged events; these being the tactics generally employed to nurse statistics to match targets set out by Government. The latter method is also that most employed against the ‘enemies of the state’, as the politically inclined judiciary sees those who live by a common sense rather than by an imposed manner. Hence men can urinate in the street, even on church doors, but the man who would castigate such dogs for doing so is a villain, a criminal, who deserves the full force of the law to punish him; that is the situation which has somehow come about and it is this state of affairs which threatens to cripple our hard won civil liberties and will maybe consign this “modern” society to a very unpleasant demise.
The American legal model, which Britain, led by a sightless Home Secretary’s lead, appears to be following more and more, is one wherein the denying of civil liberty is seen as the norm and wherein confinement is regarded as a bona fide business; thus more Americans are locked away for periods of their life, for spurious reasons, than is the case with citizens of any other country. It is this style of control, this dysfunctional method of punishment, which the current New Labour government apparently considers to be a worthy model for them selves to follow. Hence the self styled motto ‘tough on crime, tough on the causes of crime’ is bandied about while in fact the toughness realised does nothing to bolster either claim, being in fact medieval in approach. Because as any seasoned professional working in the community services sector will tell you, the only way to defeat crime is to remove the necessity for it, which involves not toughness but good government. Such a course, i.e. the denial of criminal facility is best achieved through discipline and through the encouragement of individual pride, each delivered to the person as a community experience. Within such a framework emphasis upon social responsibility and participation must be matched by a very real and tangible improvement in the living dying experience of each and every citizen. Those things which destroy men, in their mental and/or bodily function have no place amongst us and no man made system can afford to include such things if it seeks a truly good world state. Many would argue that such utopian conditions are impossible to implement; that humanity is not so balanced and therefore will never be without a so called criminal fraternity of some sort or other. It is true that throughout history, the whole effort of civilization, the binding factor of governments globally, has for the most part been that struggle of good versus bad, typified within individual progress as well as collective advancement by attitude, and that humanity somehow allowed ‘badness’ to impose goodness; hence Mankind came to be vermin to the Earth and destructive of all other creatures upon it. Scriptures, no matter their attribution, exemplify this view, being brimful of human indecision and inculcating of fear with respect to right and wrong beatitudes. In such tracts, whose purpose one can never be so sure about, human beings are, by means of fearful argument, shaped into subservient disciples of what are generally unfathomable and mostly unrevealed mysteries. Is it so surprising that, given such tools for to live and die by, humanity, virtually every single one of them, fails to lead a contented, blemish free existence?
Between them political systems and religions, though appearing to be dominating factors of a positive nature within the development of Mankind, have in truth been the complete opposite. Casual research reveals that almost every unnatural death can be attributed to failure of one or both of these systems as they impinge upon the individual living dying experience. This comes to pass because ultimately these systems are unable to evolve with the swiftness that life and death themselves transpire. For the revelation of living and dying to be properly exposed a system imposing of authority must be capable of knowing the instant, that is to say be wise to emerging events as they occur rather than after their end. The problem fundamental to both political and religious systems as means of authoritarian control is that they are unable to behave so. Our Father is an artist in heaven, not a minister of politics or religious bent! So then our man made societies, founded by badness and controlled by divisive political and religious systems cannot possibly function as good societies; they must throw up amongst their number the badness which went into their making in the first place, somehow, someway; and criminality in all its degrees is exactly how this is manifest. Human society is being moved further towards a vandalistic approach to life, everyman and their animal for them self; and the mentally insecure pay the price.

Time for change, time for indignation...

As Stalin oppressed with political law, which fostered evil, so now are British peoples oppressed the same. Kaleidoscopic style Government has a very visible downside, which is dirty and employs death; around us we are aware much vandalism and murder is being committed.
The fundamentalists, the extremists, whose very activities construct what many brave people gave up their living dying phase to resist, impose their illegitimate aims on the free world and whether they be militaristic or political or religious fanatics, they are all the same dangerous.
It is time for all men to be indignant and compose their Soul against the fundamentalist regimens which work against this Earth and creatures and peoples upon it with Worldly comprehensions.
