in theory it doesn't need to be offensive but in practice it often is

Humour *can* be used in a non-offensive way by anyone who gives a bit of thought to the feelings of others. The 'arguments' put forward in defence of 'free speech' and the like are just excuses to perpetuate downright rudeness, and the 'right' to hurt people and watch them squirm.
