When trial expenses run into tens of millions of dollars, what part does the old fashioned notion of justice play? When the real stakes in a trial become whether lawyers become millionaires (those who aren't already) or drag their law firms into bankruptcy, what hope does chance does a dimwit with a bloodstained rug have of remaining the focus of attention?

I've heard of cases where someone has been sued and sent to court-ordered mediation.
The mediator agreed with the defendents, but still awarded the person who sued mitigation of some legal fees to make them happy. The defendent didn't like that, but their insurance company forced them to accept the agreement because going to court would be more costly than paying the legal bills of the person who sued.
What a lovely system!
