I like your use of the obscure legal term, 'estop'.
It means, of course, to prevent an action by means of the principle of 'estoppel', an impediment or bar to a right of action arising from a man's own act, or where he is forbidden by law to speak against his own deed.
So, all you need is 1. to find prima facie evidence that the accused, sorry, Mr Porter, had in the past declared that he would not wear a silly hat, and 2. a good lawyer.

Sadly the use of 'estop' was a typo caused by the angry hammering out of the title. But a fortunate one. I'm now scouring the internet for evidence that he has declared his opposition to stupid hats.
And an adequate but ancient lawyer.
