Parking ticket issued for breakdown - please advise!!

Turnham Green

I would greatly appreciate any advice on the PCN issued last year - I am still fighting this!

I brokedown on Turnham Green and was blocking 3 lanes of traffic
Two/three passers-by pushed me to the side of the road - half on the footpath and half on the road
I was subsequently issued with a fine for "parking" there
I appealed detailing the breakdown circumstances - it was declined
I appealed again and provided a witness statement from a passenger in the car. I requested footage of the area before and after the still pictures that they used to support the violation and have been repeatedly told that this does not exist/is not available- this would clearly show what happened.
I have been referred to PATAS and have just received a letter saying that they have declined my appeal. I have not been able to make any personal representation to the Adjudicator and in the letter, the Adjuidcator notes that in the footage I don't look particularly "distressed" or "agitated" - also says that there is not enough evidence to support my claim of a breakdown

I am totally astonished by the whole process and would appreciate any advice re how I take this further - I doubt that the Adjudicator would expect a male driver to show signs of agitation or distress. Notwithstanding all of that - this was a clear breakdown - incredible to think of the tax money that has been spent on this ridiculous process when we are in the midst of public cut-backs on essential services - I just cannot bring myself to submit without further appeal

smiley - yikes I have no advice either - I'm afriad I rarely drive - but there surely if they have fottage of you not looking distressed the footage must exist!

Perhaps the TV programme Watchdog has some advice? Or the Citizen's Advice Bureau?

As I understand it (and I'm not a solicitor so I don't know for certain), you don't have the legal right to review the footage yourself, if there is any, but your solicitor can. If you're to have any chance of successfully challenging the appeal you will need to be able to prove the breakdown occurred and the car was incapable of being moved (note they are not the same thing). The obvious question to ask is did you call out the AA, RAC etc.? If so, you will have a paper trail to show them. If you have nothing on paper then I doubt you will get any further, given that they have already ruled against you on the appeal. I would advise you go to your solicitor and ask them for a free consultation (most will agree to that). If you're going to make a challenge the solicitor would have the best chance of success.
